This Fair Use Policy forms part of Neotech Systems Limited's Terms and Conditions and applies to: Business Mobile, Business Broadband, Cloud Phone (VoIP), and Website Hosting.

This Fair Use Policy forms part of Neotech Systems Limited's Terms and Conditions. It explains how our telecommunications and hosting services should be used to ensure reliable, secure and fair access for all customers. We aim to work with customers before taking restrictive action wherever reasonably possible.

Scope

Which services this policy covers

This Policy applies to Business Mobile, Business Broadband, Cloud Phone (VoIP), Website Hosting and any future service promoted as unlimited or subject to fair use. Website Development services are not subject to this Policy unless specifically stated.

Fair Use Principles

How we assess usage

High usage alone does not automatically breach this Policy. We assess usage by considering:

  • Volume and duration of use
  • Frequency and pattern of activity
  • Impact on the network
  • Impact on other customers
  • Compliance with supplier obligations

General Acceptable Use

Prohibited activities across all services

Customers must not use Services for:

  • Unlawful activity or fraud
  • Spam, phishing, or malware distribution
  • Denial of service attacks
  • Copyright infringement
  • Unauthorised access to systems
  • Resale of services without approval
  • Any activity that compromises network integrity
Breach of acceptable use may result in suspension or termination of your Services. Serious or repeated breaches may be reported to relevant authorities.

Business Mobile

Fair use rules for mobile plans

Unlimited plans are intended for normal business communications. They must not be used for:

  • SIM gateways or auto-diallers
  • Bulk SMS or robocalling
  • Unauthorised machine-to-machine communications
  • Premium-rate abuse
  • Continuous replacement of fixed office broadband where this materially affects the network

Business Broadband

Intended use and restrictions

Business Broadband is intended for genuine business internet access including email, cloud services, remote work and collaboration. Customers must not intentionally overload shared infrastructure or undertake unlawful activities.

Cloud Phone (VoIP)

Prohibited use of VoIP services

Cloud Phone Services must not be used for:

  • Scam calls or caller ID spoofing
  • Illegal robocalling
  • Emergency service misuse
  • Fraudulent traffic generation

Website Hosting

Hosting restrictions and acceptable content

Hosting services must not be used to:

  • Distribute malware or send spam
  • Host phishing sites or illegal content
  • Run cryptocurrency mining workloads
  • Undertake activities that unreasonably affect shared hosting resources

Some service limitations may be imposed by upstream carriers or infrastructure providers. Customers agree to comply with reasonable technical or operational requirements that arise from those relationships.

Neotech is your single point of contact for all service issues. Please do not contact our Wholesale Providers directly.

Network Management

Traffic shaping and maintenance

Neotech may implement proportionate traffic management during congestion, security incidents or network maintenance to maintain service quality and protect all users.

Security and Fraud Prevention

How we protect you and our network

We may investigate suspected fraud, unusual traffic patterns or security incidents. Where appropriate we may temporarily restrict affected services while investigations are completed.

Monitoring

What we do and do not monitor

We do not routinely monitor the content of communications. We may monitor technical information, service usage and network performance for operational, security, fraud prevention and legal compliance purposes.

Excessive Usage

Our approach to high usage accounts

Where usage is consistently outside reasonable expectations for the selected plan, we will normally contact the customer first to discuss suitable options. We may recommend a different plan or managed solution.

We aim to work with customers before taking any restrictive action. If your usage has increased significantly, please contact us and we will help find the right plan.

Enforcement

Actions we may take for breaches

Where necessary we may take the following actions:

  • Issue a formal warning
  • Manage or shape traffic for the affected account
  • Restrict specific activities
  • Suspend services for serious or repeated breaches
  • Terminate services for illegal activity, fraud or threats to network security

Customer Responsibilities

Your obligations under this policy

Customers are responsible for:

  • All use of their account
  • Maintaining appropriate security measures
  • Protecting passwords and access credentials
  • Ensuring all authorised users under the account comply with this Policy

Changes

How we update this policy

Neotech may update this Policy from time to time. The latest version will be published on our website. Continued use of the Services constitutes acceptance of the updated Policy.

Governing Law

Legal jurisdiction and related documents

This Policy is governed by the laws of New Zealand and should be read together with the Neotech Terms and Conditions and applicable New Zealand legislation.
